    WCAB Resolves Lien Deadline Issue

    Lien claimants who filed required supplemental lien declarations on July 2 or 3 of 2017 wondered: would the Workers’ Compensation Appeals Board (WCAB) agree to adjudicate those liens? Recently, the WCAB finally made their decision.

    California’s Division of Workers’ Compensation (DWC) mass-dismissed over 292,000 previously filed liens in August, for failure to timely file the retroactive lien declarations by the deadline of July 1. In October, the DWC lifted the dismissal notice on liens for which claimants filed the declaration on July 2 or 3, since July 1 fell on a Saturday.

    The liens’ fates were unclear, until last week’s WCAB decision: if the claimant filed their declaration by 5pm on Monday, July 3, they were on time.

    DWC Reconsiders Lien Declarations Filed July 2-3

    When the California Division of Workers’ Compensation (DWC) mandated that lien claimants must file declarations asserting the validity of their liens, they weren’t kidding around. In August, the DWC dismissed over 292,000 previously filed liens for failure to file retroactive Supplemental Lien Declarations by the established deadline of July 1, 2017.

    Now, it appears the DWC may change its mind regarding some of those dismissals. This week, the DWC announced that it will lift the dismissal notice on liens for which claimants filed the Supplemental Lien Declaration on July 2 or 3.

    DWC Database of Dismissed Liens Available

    You may recall last month’s dismissal of over 292,000 unresolved liens by California’s Division of Workers’ Compensation (DWC). The DWC closed the lien cases for failure to comply with new declaration requirements mandated by SB 1160. On August 14, 2017, the DWC dismissed the liens on procedural grounds “by operation of law." The dismissed liens are now publicly available through a searchable database posted on the DWC website.
