DWC Public Hearing: Copy Service Fee Schedule

Have thoughts to share with the Division of Workers’ Compensation (DWC) regarding proposed changes to the Copy Service Fee Schedule? Mark your calendar. The DWC will hold a public hearing on the matter at 10 a.m. Friday, February 25, 2022.

Any interested party may attend the meeting via Zoom. Specifically, two changes are up for discussion.

Proposed Fee Schedule Changes

The DWC public hearing comes as a follow-up to a prior meeting held on August 30, 2021. The DWC is searching for feedback on two potential updates to the Copy Service Fee Schedule:

  1. Raising the flat rate for copy services of records up to 500 pages from $180 to $230. The flat rate is intended to include “all associated services” such as subpoena preparation, witness fees for delivery of records, and pagination.

  1. A potential provision relieving claims administrators of liability for payment when duplicate copies of records are sent to the Independent Medical Review Organization.

Written Comments Encouraged

According to a recent Newsline, “The proposed amendments to the Copy Service Fee Schedule are exempt from the rulemaking provisions of the Administrative Procedure Act.” Nevertheless, before the suggested changes can become final, the DWC must:

  • Hold a 30-day public comment period
  • Host an open-to-the-public hearing
  • Respond to all comments
  • Publish an order adopting the new regulations online

Until February 25, 2022, the public may offer the DWC written comments about the suggested modifications to the Copy Service Fee Schedule.

The DWC encourages
advance notice if you plan to speak at the hearing. Those interested in speaking may notify the DWC of their intentions to speak at DWCRules@dir.ca.gov. The deadline for advance notice is 5 p.m. Thursday, February 24, 2022.

The DWC has indicated there will also be a chance to register to speak once the Public Hearing commences.
